- General Summary of the Program:
Under the New York Electronic Equipment Recycling and Reuse Act, manufacturers of covered electronic equipment must implement a plan for the collection, consolidation and recycling of electronic waste from New York consumers. Manufacturers will have a market share recycling obligation based on a statewide goal that increases each year. Manufacturers are able to work with collection sites, consolidation facilities, and recycling facilities to meet their market share obligation. Only in-state collection sites, consolidation facilities, and recycling facilities are required to submit a one time registration to the New York State Department of Environmental Conservation. All manufacturers of covered electronic equipment must submit an annual registration.

Covered Electronic Equipment (CEE) - Computers (desktop, laptop), computer peripherals (computer monitors with a visual display component greater than 4 inches measured diagonally; keyboards; mice or similar pointing devices; fax machines that weigh less than 100 pounds; scanners that weigh less than 100 pounds; and printers that weigh less than 100 pounds), small electronic equipment (portable digital music players that have memory capability and are battery-powered; video cassette recorders; DVD players; DVRs; digital converter boxes; cable or satellite receivers; or electronic or video game consoles), small-scale servers, and televisions with a viewable area greater than four (4) inches measured diagonally.

Electronic waste - Any covered electronic equipment [computers (desktop, laptop), computer peripherals (computer monitors with a visual display component greater than 4 inches measured diagonally; keyboards; mice or similar pointing devices; fax machines that weigh less than 100 pounds; scanners that weigh less than 100 pounds; and printers that weigh less than 100 pounds), small electronic equipment (portable digital music players that have memory capability and are battery-powered; video cassette recorders; DVD players; DVRs; digital converter boxes; cable or satellite receivers; or electronic or video game consoles), small-scale servers, and televisions with a viewable area greater than four (4) inches measured diagonally] that has been cdiscarded or is no longer wanted by its owner, or for any other reason enters the waste collection, recovery, treatment, processing, or recycling system.

Consumer - any New York entity that owns or uses covered electronic equipment, including but not limited to an individual, a business, corporation, limited partnership, not-for-profit corporation, the state, a public corporation, public school, school district, private or parochial school or board of cooperative educational services or governmental entity.
